Terms of Service | PlayMind Labs

1. Acceptance

By accessing or using PlayMind Labs services, including the RiskOS API and associated dashboards (the "Service"), you ("Customer") agree to be bound by these Terms of Service ("Terms"). If you are accepting on behalf of a company, you represent that you have authority to bind that entity. If you do not agree, do not use the Service.

2. The Service

PlayMind Labs provides a behavioral risk scoring API that analyzes player session data and returns tilt scores, risk classifications, and intervention recommendations. The Service is provided as-is for integration into licensed gaming platforms. PlayMind Labs does not operate a consumer gambling platform and is not a licensed gaming operator.

3. Eligibility and Permitted Use

The Service is available only to licensed operators, registered businesses, or their authorized technology partners. You must:

Be a legal entity or individual of legal age in your jurisdiction
Hold all licenses required to operate a gaming or financial platform in your jurisdiction
Use the Service only for lawful purposes consistent with applicable law

You may not resell, sublicense, or white-label the Service without a written agreement with PlayMind Labs.

4. API Keys and Access

API keys are confidential. You are responsible for all activity that occurs under your credentials. You must promptly notify us at [email protected] if you suspect unauthorized access. PlayMind Labs reserves the right to suspend access for suspected abuse or security incidents.

5. Data and Privacy

You are the data controller for player data submitted to the API. PlayMind Labs acts as a data processor. You represent that you have obtained all necessary consents and have the legal right to submit such data. Our handling of submitted data is governed by our Privacy Policy and any applicable data processing agreement.

6. Intellectual Property

PlayMind Labs retains all rights, title, and interest in the Service, including the scoring models, algorithms, and software. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described here.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. PLAYMIND LABS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT SCORING OUTPUTS WILL BE ACCURATE IN ALL CASES. RISK SCORES ARE INFORMATIONAL AND DO NOT CONSTITUTE LEGAL, COMPLIANCE, OR REGULATORY ADVICE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLAYMIND LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM.

9. Termination

Either party may terminate access to the Service upon written notice. PlayMind Labs may immediately suspend or terminate access for material breach of these Terms, non-payment, or conduct that poses a security or legal risk.

10. Governing Law

These Terms are governed by the laws of the State of New York, USA, without regard to conflict of law principles. Disputes shall be resolved in the state or federal courts located in New York County, New York.

11. Changes

We may update these Terms. Continued use of the Service after changes become effective constitutes acceptance. Material changes will be communicated with at least 14 days notice via email or the website.
